Jail marriage instructions

Step-by-step guidance for getting legally married when one partner is incarcerated.

Step 1

Order your marriage package

Begin by ordering one of our virtual marriage packages. Once your order is confirmed, we’ll email you the required form:
“Absent Spouse Notarized Marriage License Application.”

  • The non-incarcerated partner should complete the form as Applicant 1.
Step 2

Notarize & mail the form

Have the completed form notarized, then physically mail it to Utah County:

⛔Note: Utah does not accept digital copies—even if the incarcerated person has internet access or an ID on file, the notarized form must be mailed.
Step 3

Provide valid inmate identification

Include a copy of the incarcerated partner’s valid ID along with the notarized form. The ID must show:
  • Full name
  • Date of birth
  • Clear photo

Accepted formats:
  • Government-issued ID
  • Jail wristband (if it includes name, DOB, and photo)
  • A previously scanned/photocopied ID held by the partner (can be mailed separately)

📩 If sending the ID separately, notify the clerk by emailing: marriage@utahcounty.gov
Step 4

Await Utah county’s approval

Once received, Utah County will process the application and complete the incarcerated partner’s portion.
They will then:
  • The non-incarcerated partner should complete the form as Applicant 1.
Step 5

Submit payment & shipping info

After approval:
  • Enter the shipping address where the license should be mailed
  • Pay for the license through a secure Utah County payment link

✅ Your official marriage license will be sent directly to the non-incarcerated partner.

⏳ Timeline

Expect the full process to take approximately 1 to 3 weeks, depending on mail speed and internal review.

🎥 Ceremony Requirements

A Zoom video call is required for the ceremony.
  • The incarcerated person must have video access, typically coordinated by a jail staff member, attorney, or approved contact.
  • Someone on-site must be available to help launch and manage the Zoom session.
